Terms of Service

1. Acceptance of Terms

By creating an account or using Track Spend, you agree to these Terms of Service. If you do not agree, do not use the service. These terms form a binding agreement between you and Track Spend.

2. Description of Service

Track Spend is a personal finance tool that analyses uploaded bank statements using AI to provide spending insights and budget recommendations. We are not a financial services provider and do not provide regulated financial advice as defined under the Financial Advisory and Intermediary Services Act (FAIS), 2002.

3. Your Account

• You must be 18 years or older to use Track Spend.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information when creating your account.
• One account per person. You may not share accounts.

4. Subscription and Billing

• Every account begins with a 7-day free trial, which starts automatically on sign-up. It requires no payment card, creates no subscription, and charges nothing.
• The trial includes 10 AI chat messages and 2 statement uploads in total. These are once-off allowances for the account and do not reset. The trial ends after 7 days or once those allowances are used, whichever occurs first.
• When the trial ends, data you have already uploaded remains accessible. New uploads and AI chat are unavailable unless you subscribe. There is no free plan beyond the trial.
• Track Spend offers two paid subscriptions, both billed monthly via Paystack: Basic at R 29/month and Pro at R 149/month.
• Basic includes the full dashboard, automatic spending insights, and 1 statement upload per month. AI chat and on-demand insight regeneration are not included.
• Pro includes everything in Basic plus unlimited AI chat (subject to a fair-use policy), on-demand insight regeneration, and up to 4 statement uploads per month. Monthly upload allowances reset on the 1st of each month.
• Subscriptions renew automatically each month until canceled.
• You may cancel at any time; access continues until the end of the billing period.
• Refunds are not issued for partial months, except where required by law.

5. Cooling-Off Period (Consumer Protection Act)

In accordance with section 16 of the Consumer Protection Act, 2008, you have the right to cancel any transaction resulting from direct marketing within 5 (five) business days of the date of the transaction, without penalty and without giving any reason. To exercise this right, email support@track-spend.com within the cooling-off period. Any amount paid will be refunded within 15 business days of cancellation. This cooling-off right does not apply where services have already been fully rendered with your prior express consent before the end of the cooling-off period.

6. Acceptable Use

You agree not to:

• Upload documents you do not own or have permission to share.
• Attempt to reverse-engineer, scrape, or abuse the service.
• Use the service for any unlawful purpose under South African law.
• Attempt to circumvent usage limits or access controls.

7. Intellectual Property

All content, trademarks, and software comprising Track Spend are owned by or licensed to Track Spend. Your uploaded statements and financial data remain your property. You grant Track Spend a limited licence to process your data solely to provide the service.

8. Disclaimer of Warranties

Track Spend is provided "as is" without warranties of any kind. AI-generated insights are for informational purposes only and may contain errors. We do not guarantee accuracy, completeness, or fitness for any particular purpose. Always verify important financial decisions with a qualified professional.

9. Limitation of Liability

To the maximum extent permitted by South African law, Track Spend shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the three months preceding the claim.

10. Termination

You may delete your account at any time via Settings. We may suspend or terminate accounts that violate these terms. Upon termination, all your data is permanently deleted in accordance with our Privacy Policy.

Deleting your account cancels any active subscription immediately, not at the end of the billing period. The remainder of a month you have already paid for is forfeited and is not refunded. If you wish to use the time you have paid for, cancel your subscription first and delete your account once the period ends.

11. Changes to Terms

We may update these terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
